Article 265 of the constitution mandates a ten year review of seven ‘Other Commissions’ which were established to address discrimination, exclusion and marginalization and hold the state accountable for their inclusive empowerment. With the ten year anniversary of the constitution approaching, Niti felt it pertinent to discuss the process of review of these constitutional bodies. Amid voices rising for the amendment of the constitution in the political scene, this study was done to create a discourse on the review of constitutional bodies which might fall on the backburner amidst contentious issues like electoral reform and federal governance structure. It provides a rich background on the conception of these commissions during the constituent assembly, moving on to an exploration of legal frameworks that would guide the review process. After extensive discussion with actors and multiple workshops the Suggestion Paper has devised a framework and highlights crucial elements that need to be considered during the review. The paper was mainly authored by Senior Advocate Raju Prasad Chapagai with editorial input from Niti.
